Property defect claims filed against public entities must be timely filed. For example, in New Jersey, an injured party only has 90 days to notify the appropriate authorities of an accident caused by a defect. Thereafter, a trial court needs to approve the late filing of the claim. In most cases, a claim first submitted more than one year after the accident will be barred. This is an exception to the general rule that you have two years to commence a lawsuit for personal injury claims in New Jersey.
